In Texas the type of mortgage used is called a Deed of Trust. The mortgage document is a 3 party instrument including the Trustor (purchaser), Trustee (disinterested third party), and the Beneficiary (lender). A Lien is a Claim or Cloud on Title. 5 Types of Property Liens are as Followed. 1. Specific lien- Attached to one or more specific items of the owner. 2. General Lien- Attaches to all of the property of an owner not exempt from forced sale. 3. Tax Lien- Unpaid Property taxes and/or IRS Taxes. 4. Mechanic’s and Materialman’s Lien (M&M Lien)- A Lien for the purpose of securing payment for work or material furnished for repairing property. 5. Judgment Lien- Arises from lawsuits where money damages were awarded. Law permits a hold to be placed on the personal and real property of the debtor until the damages are paid.
