California lien law will require that a preliminary notice be served upon the lender Effective July 1, 2012, if any, on private works projects. The new statute provides that the prime contractor
must provide you with owner and lender information upon request. The mortgage, deed of trust, or other instrument securing a loan, any of the proceeds of which may be used for a work of improvement, shall bear the designation “Construction Trust Deed” and shall include the required information. Be proactive and obtain the lender information up front so that your rights are protected and you can avoid added investigative costs when serving your notice!
