A mountain of debris left over from the 1994 Northridge earthquake in Huntington Park, California has generated another lawsuit.(See Los Angeles County Superior Court Case No. BC330662). The debris, placed on the property by a former tenant and a source of contention between the City of Huntington Park and nearby residents, was removed from the property at the expense of the property owner. In late July 2005, Judge Paul Gutman ordered the property, located at 6208 South Alameda Avenue, Huntington Park and valued at more than $ 6.5 million, be sold to satisfy more than $ 2.5 million in liens against the property for the cost of the clean up and removal of the debris.
The sole owner and president of the corporation which owns the property, is alleging that the City and LAUSD are intentionally interfering with the sale of the property by contacting potential buyers. The owner received several unsolicited offers for the property, even before the court ordered the sale. The owner has sought, through the court, to accept an offer made by a charter school funded through grants from the State of California. The school, which has an approved State Allocation Board apportionment of over $ 19 million for a school in Los Angeles, had planned to build and operate a school at the five acre site, but backed off its offer following calls it received from a Regional Development Manager for LAUSD. He has asserted that the LAUSD would take the property by eminent domain at a price less than the charter school’s offer in order to effectuate a land swap with the City of Huntington Park for another property.
The lawsuit was filed on September 12, 2005 against the City of Huntington Park and Los Angeles Unified School District, on behalf of 6208 South Alameda Corporation, the owner of property located at 6208 South Alameda Avenue, Huntington Park, California and Myron Z. Chlavin, the sole owner and president of the corporation. The plaintiffs are represented by Jackson & Wallace, LLP, attorneys specializing in complex litigation.
Another offer for the property has been made by a real estate developer. The developer was contacted by Huntington Park’s mayor and advised to rescind his offer because he would not get the proper permits and approvals to develop it. The mayor told the developer that the City wants LAUSD to obtain the property in order to swap it with the City.
Myron Z. Chlavin, the seventy-five year old sole owner and president of 6208 South Alameda Corporation, has also alleged severe emotional distress as a result of the City’s and LAUSD’s actions. While Chlavin and the corporation did not place the debris on the property, they have attempted to work with the City throughout the years since the Northridge earthquake to effectuate its removal. “The use of the property for a charter school would be most beneficial to the community and in keeping with the City’s strategic plan to improve its business district. I cannot think of a better buyer for a property that has been in my family for more than seventy-five years than a charter school,” said Mr. Chlavin. “The interference by the City and LAUSD is just another attempt to delay this situation and drag it out for months, if not years,” Chlavin continued. “I hope we can resolve this as soon as possible for the community’s sake.”
